WHAT IS THE MEMORY OF THE PILGRIMS OF THE 21ST CENTURY?

The main objective of the MEMORY OF THE PILGRIMS OF THE 21ST CENTURY is to offer pilgrims a space in which to share their stories and experiences of the Camino, in order to create a memory of the pilgrimage which will contribute to the promotion and preservation of the verbal heritage of the Camino de Santiago. The project also seeks to create a meeting place and an exchange of information for pilgrims and all those who are interested in pilgrimages to Santiago.

The MEMORY OF THE PILGRIMS OF THE 21ST CENTURY is not a contest. There are no winners or losers, nor are there any prizes for participating. In just the same way, the gathering and recording of pilgrims’ testimonies will not involve any monetary gain for the Fundación Jacobea.

PROMOTORA FOUNDATION.

The FUNDACIÓN JACOBEA is responsible for this initiative. Its registered office is in Rúa Azabachería, 14, 15704, Santiago de Compostela (A Coruña) and CIF G70415666, and it is the owner of the website www.fundacionjacobea.org. In this web portal, users can share with the Fundación Jacobea testimony of their pilgrimages to Santiago de Compostela, in compliance with the provisions of the following rules.

HOW TO PARTICIPATE.

To participate in the contents of the website www.fundacionjacobea.org, users must send an email to the address provided by the company on the said web portal to which is attached or which includes a story or testimony of their pilgrimage. This may be written in English or Spanish.

All users who send their testimonies to www.fundacionjacobea.org must attach the name under which they wish their testimony to appear. The published testimonies and experiences will have a general character and will avoid as far as possible the use of personal data, so preferably the indicated name should be limited to either a first name or a pseudonym. In any case, the provisions of point 6 below shall apply to everything related to the protection of personal data of users who submit their testimonies.

INTELLECTUAL PROPERTY RIGHTS AND ON THE USE OF OWN IMAGE.

The users who send their testimonies guarantee the FUNDACIÓN JACOBEA that they are the rightful holders of all the intellectual property rights that may exist on the aforementioned testimonies, as established in Royal Legislative Decree 1/1996, of April 12, by which the revised text of the Intellectual Property Law is approved, either because they are the authors or because they are the legitimate holders of any such title. In the case of moral rights, users guarantee that the FUNDACIÓN JACOBEA is given the name of the author of the work. Likewise, they guarantee that they can legitimately send the testimonies and that they do not infringe in any case the intellectual property rights of third parties.

Likewise, and in the case that in the testimonies the image of a person appears, the users guarantee that they have the necessary authorizations for it or that there is no illegitimate interference or infringement of any right, as established in the Organic Law 1 / 1982, of May 5, civil protection of the right to honor, to personal and family privacy and to one’s own image.

Participants in the initiative who submit testimonies consent to the publication of the same on the FUNDACIÓN JACOBEA website and, where appropriate, in other formats written under the ownership, direction or control of the FUNDACIÓN JACOBEA and, for that purpose , participants assign to the FUNDACIÓN JACOBEA all rights of reproduction, distribution, public communication and transformation of those who are owners for the reproduction and dissemination of such testimonies both on its website www.fundacionjacobea.org and on other platforms owned, as well as in the social networks where the FUNDACIÓN JACOBEA is present. Given the nature of the initiative and that the MEMORY OF THE PILGRIMS OF THE 21ST CENTURY will not directly involve any monetary or non-monetary income for the FUNDACIÓN JACOBEA in the use of these testimonies, the exploitation rights included in the cession do not permit the gainful earning of any monetary sum whatsoever as a consequence of the commercialization of the testimonies through any system or method.

This agreement applies for all the countries of the world and for the duration of exploitation rights, according to the applicable legislation. The transfer of rights is made without exclusivity, so that participants retain the possibility of using these materials themselves and benefitting from the corresponding intellectual property rights, but provided that this use does not impede, damage or limit their use by the FUNDACIÓN JACOBEA in the terms and with the aims previously stated.

USE OF THE TESTIMONIES AND NAME OF THE AUTHORS

The JACOBEA FOUNDATION reserves the right to make a selection among all the testimonies received, based exclusively on its own criteria and may without any public justification include all, several or none in its website www.fundacionjacobea.com and in other proprietary platforms of the JACOBEA FOUNDATION, as well as in the social networks in which the JACOBEA FOUNDATION is present.

All the testimonies used will include the name or pseudonym that the author has provided in a visible place of the same, to which the participants have given their consent. Participants also agree that the JACOBEA FOUNDATION may use their testimonies, as well as the name that each author sends, in any advertising, promotional or marketing activity related to www.fundacionjacobea.org in any medium, without these activities conferring rights of remuneration or any other benefit.

PROTECTION OF DATA OF PERSONAL CHARACTER.

Purposes:

The purposes of the processing of personal data are the following:

  1. To oversee the participation in the initiative MEMORIA DE LOS PEREGRINOS DEL SIGLO XXI with the activities that are involved.
  2. To deal with the people who participate in the initiative MEMORIA DE LOS PEREGRINOS DEL SIGLO XXI ; to answer their queries, doubts, complaints and comments related to their participation.
  3. To manage contact and communication with participants in the initiative MEMORY OF THE PILGRIMS OF THE 21ST CENTURY as a place of encounter, exchange and information for pilgrims and those interested in pilgrimages to Santiago.

Legitimation:

The legitimacy of these activities is based on the consent of the participants in the initiative MEMORIA DE LOS PILGRIMOS DEL SIGLO XXI.

Recipients: The personal data provided by the participants in the MEMORIA DE LOS PEREGRINOS DEL SIGLO XXI initiative for the purposes indicated will only be transferred in the cases provided for in the laws that are applicable.

Rights: Participants have the right of access, in order to rectify or delete data. This, as well as other rights, is explained in the legal notice.

Duration: The personal data provided by the participants will be kept for the duration of the use of the testimony within the initiative MEMORIA DE LOS PEREGRINOS DEL SIGLO XXI in the terms indicated above and will last for as long as there exists a policy of contact and communication with participants, with the aim of establishing a meeting place, an exchange of information for pilgrims and all those interested in the pilgrimages to Santiago.

Notwithstanding the provisions of point 5 above regarding the inclusion of the name or pseudonym provided by the author of the testimony and its use in any advertising, promotional or marketing activity related to the MEMORIA DE LOS PEREGRINOS DEL SIGLO XXI initiative, the JACOBEA FOUNDATION ensures that personal data will be treated confidentially and to use them only for the purposes indicated.

ACCEPTANCE OF THE TERMS

The check box “I accept the legal bases and privacy policy” that appears in the section “Participates” in the website www.fundacionjacobea.org supposes the full and unconditional acceptance of these Bases, the subjection to the norms that are applicable, as well as the express submission to the interpretative decisions made by the JACOBEA FOUNDATION regarding the resolution of any issue derived from participation in the MEMORY OF THE PILGRIMS OF THE 21ST CENTURY. Ultimately, the initiative and its development will be subject to the applicable Spanish regulations and in case of litigation the dispute will be resolved by the Courts and Tribunals of Santiago de Compostela (A Coruña), Spain, without prejudice to the jurisdiction that may correspond according to the mandatory regulations applicable.
